Eligibility. The Chili's Margarita Madness Contest (the “Contest”) is open only to legal residents of the fifty (50) United States and District of Columbia who are 21 years of age or older.  Employees, contractors, directors and officers of Sponsor, Promotion Activators, Inc. and their parents, subsidiaries and affiliated companies, distributors, and the advertising, fulfillment, judging and promotion agencies involved in the development and administration of this Contest (collectively, “Contest Parties”), and their immediate family members (parent, child, sibling and spouse of each) and those living in the same households of each are not eligible. Void where prohibited by law.  By participating, Entrants agree to these Official Rules and to the decisions of the judges, which will be final and binding in all respects. By submitting an Entry, you agree that your disclosure is gratuitous, unsolicited and without restriction, and will not place Sponsor under any obligation, that is free to disclose the ideas contained therein on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your submission, Sponsor does not waiver any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you.  Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants. BY SUBMITTING AN ENTRY, ENTRANT ACKNOWLEDGES THAT HIS/HER ENTRY MAY BE POSTED ON SPONSOR’S WEBSITE, IN SPONSOR’S DISCRETION. By entering, you acknowledge that Sponsor has no obligation to use or post any Entry you submit. 

How to Enter. The Chili's Margarita Madness Contest (the “Contest”) begins at 12:00:01 a.m. CDT on March 29, 2007 and ends at 11:59:59 p.m. CDT on July 18, 2007 (the “Contest Period”).  Entrants must log onto www.chilismargaritamadness.com, complete the online entry form and submit an original design depicting Margaritas using the tools provided on the website (“Entry”). Your Entry will be submitted in the competition for one (1) of twelve Chili’s Regions.  Entries must be in English and the original work of the entrant.  The Entry must not have won previous awards; must not have been published previously; must not infringe third-party rights, and must be suitable for publication.  All Entrants will be required to complete an Entry form that must include entrant’s Name, Age, Street Address, City, State, Zip Code, Telephone Number and email address.  Entry must not contain profanity, reference to nudity, extreme violence, threatening language, and/or be inappropriate, indecent or obscene as determined by Sponsor in its sole discretion. All submissions become the exclusive property of the Sponsor. No personal names, trademarks, copyrighted material or company names or other intellectual property owned by third parties may be included, other than those owned by Sponsor.  Submission of an Entry grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify such Entry in any way, in any and all media, without limitation, and without consideration to the Entrant. Submission of any Entry further constitutes the Entrant’s consent to irrevocably assign and transfer to the Sponsor any all rights, title and interest in the Entry, including, without limitation, all copyrights.    If you think that any Entry infringes your intellectual property rights, click here if you wish to report it

Number of Entries and Disclaimer of Liability Regarding Entries. You may enter the Contest an unlimited number of times during the Contest Period; however, each Entry must be substantially different and be submitted separately. Sponsor is not responsible for lost, stolen, illegible, misdirected or late submissions. Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. At the Sponsor's discretion, entries that contain unsuitable content or that are in violation of third party rights (including, but not limited to, copyrights) will be immediately disqualified. Sponsor retains sole discretion as to what constitutes unsuitable content and will not be liable in any way for disqualified entries. 


Judging.  Entries will be judged by a qualified panel of judges based upon relevance to theme (50%) and creativity/originality (50%). The decisions of the judges will be final and binding on all matters relating to this Contest. At Sponsor’s sole discretion, 3 entries from each Chili’s region will be chosen and put on display for online voting.  In the unlikely event of a tie in any region, tie will be broken by the highest score in the creativity/originality category. Consumers may visit www.chilismargaritamadenss.com and vote from 12:01:00 a.m. CDT, August 1, 2007 to 11:59:59 p.m. CDT, August 15, 2007.  Winners will be announced on August 22, 2007. Consumers will be asked to vote for the submission they like best.  Consumers are limited to one vote per day for the same Entry/Entry on display on the voting website per region. The Entry which receives the most votes per region at the end of the online judging period, will win a Grand Prize. In the unlikely event of a tie in any region for a Prize, a vote-off under the same conditions will be conducted between the tied winners in such region on dates and times designated by Sponsor. 

Prizes.  One (1) Grand Prize will be awarded in each Chili’s region.  Prize is a private Margarita Madness party for one (1) winner and twenty (20) friends/family.  The private party will take place at a Chili’s location near the winner’s residence.  The Grand Prize includes an educational session on Margaritas and the history of tequila, food/meal by Chili’s, and informational material to take home. The trip does not include transportation or any other expenses not set forth herein. Approximate Retail Value (“ARV”):  $1,000. Actual value varies, depending on winner’s location. Any and all other expenses associated with the Grand Prize not specifically mentioned in these rules are winner’s sole responsibility. All “private Margarita Madness” parties must be fulfilled within six (6) months from the time of notification of prize or will be forfeited.  No substitution, cash redemption or transfer of prize is permitted except at Sponsor’s sole discretion.  If prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Any portion of the prize not accepted by winner shall be forfeited. APPROXIMATE TOTAL RETAIL VALUE (“ARV”) OF ALL PRIZES: $12,000. 

Affidavit of Eligibility and Liability/Publicity Release. Winners will be required to sign a Winner's Affidavit and Liability Release and return it within seven (7) days of prize notification or prize will be forfeited in its entirety and will be awarded to the next highest scoring entrant in the applicable region. No prizes will be awarded until such signed release from winner is received by Sponsor. By submitting an Entry, a winner agrees to allow use of his or her name and Entry, in full or in part, for any and all purposes in any and all media now known or hereinafter developed without territorial or time limitations and without compensation, including, but not limited to for promotional and advertising purposes.
General Terms & Conditions. Allow up to 6 weeks for the Sponsor to contact winners to arrange Margarita Madness party following verification.  If any Contest prize notice or Contest prize is returned as undeliverable, or if information provided by potential winner is unintelligible, prize will be forfeited. By participating in the Contest participant agrees to release, hold harmless and indemnify Sponsor, Aspen Marketing Services, their respective parent companies, affiliates, subsidiary companies, distributors, sales representatives, retailers, advertising, sales promotion and judging agencies and the employees, directors, officers and agents of each from and against any and all liability whatsoever for any injuries, losses, harm, damage (including but not limited to property damage, personal injury and/or death), claims, actions, costs and expenses (including without limitation, all attorney’s fees and court costs) arising directly or indirectly from, or in connection with, his/her participation in the Contest, acceptance, possession or use/misuse of the prize or participation in any prize-related activity or any use of the Entry submitted.  Winners are solely responsible for any local, state, or federal income taxes on prizes. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of the promotion, including without limitation, barring and disqualifying participants who do not comply with these Official Rules. By entering, Entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules.  By entering, Entrants’ consent to the jurisdiction and venue of the federal, state and local courts located in Dallas, Texas.

Additional Warranties and Indemnity. Sponsor reserves the right at its sole discretion to disqualify any individual tampering with the Entry process or the operation of the Entry Website or to be acting in violation of the Official Rules. Sponsor reserves the right in its sole discretion to cancel, modify or suspend this contest, in its entirety should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor's control corrupt the administration, security, fairness, integrity or proper play of the contest. Sponsor is not responsible for incorrect or inaccurate Entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the contest by any technical or human errors, which may occur in the processing of the entries in the contest.

Sponsor(s) and Administrator. The Sponsors of the Contest are Brinker International Payroll Company, LP, 6820 LBJ Freeway, Dallas, TX 75240, and any Chili’s restaurant who has been granted written permission to use this Contest (collectively, “Sponsors”).  The Administrator is Promotion Activators, Inc., 1851 Elmdale, Glenview, IL 60026. (“Administrator”).
